Read the application and the say filed vide Exh.4. Heard Ld. Advocate for the applicant, Ld. A.P.P. for the State and the I.O. in person.

Crime stood registered bearing C.R. No.I­42/2021 with the respondent/police station against the applicant and others under Sections 384, 385, 506 r/w 34 of the Indian Penal Code and under Section 67(A) of the Information and Technology Act, 2000 for an allegations that, the complainant was instigated to remove his cloths and his naked photo was taken in the Mobile phone and fees of Rs.5,000/­ was taken by an unknown person to increase the sex power and accordingly the medicines were sent to the complainant and on the

pretext of publishing the obscene pictures of the complainant in the public domine extracted Rs.6,90,000/­ and also demanded Rs.2,00,000/­ for deleted the said photographs.

It is the case of the applicant that, he is victim in this case and he is innocent and he had received Rs.1,70,000/­ in his account, but he paid the same to his cousin brother, who is the main accused. He does not know anything about the case. Investigation is over. He is ready to abide by the terms and conditions. Therefore, prayed to allow the application.

It is the case of the respondent that the offence is serious in nature. Other accused are yet to be arrested. Maruti­Omni Car is yet to be seized and therefore, prayed to reject the application.

Upon hearing and going through the material placed on record, what can be gathered is that, it is an admitted fact that an amount of Rs.1,70,000/­ was received by the applicant in his account.

However, the applicant came to be arrested from District Beed and not from Pune District where his address is shown. Other accused persons are yet to be arrested. The investigation is in progress. Maruti­Omni Car and obscene photographs are to be seized. Mobile and other Electronics Device are to be seized. It will not be proper to enlarge the applicant on bail at this juncture. Hence, the order.

ORDER

Criminal Bail Application No.176/2022 stands rejected and disposed off accordingly.
