This is an application under section 439 of the Code of
Criminal Procedure in Crime No. 87/2022 registered at Police station,
Satpur, Nashik for the offence punishable under sections 498­A, 306, 323,
504 & 506 r.w. Sec. 34 of the Indian Penal Code, 1860. It is the case of
prosecution in brief that the accused/applicants (husband and father­in­law
of the deceased) inflicted physical and mental cruelty on her due to which
she committed suicide. It is alleged that the victim had undergone three
miscarriages and that the accused persons used to harass her and tell her
that they will get her husband married to someone else if she is unable to
retain her pregnancy.

Ld. Adv. for the applicants has submitted that there are no
allegations with respect to demand of money. There is no prior police
complaint against the applicants. Material part of the investigation is over
and charge­sheet is about to be filed. Applicants are ready to abide by the
terms and conditions imposed by the court.

Per contra, Ld. A.P.P. has opposed the bail application on the
ground that there is prima­facie case against the applicants. If they are
released on bail, there are chances of them tampering with prosecution
witnesses. The entire investigation is not yet over. Husband (applicant No.
1) is the prime accused.

Perusal of the case diary reveals prima­facie case against the

applicant no. 1. Offence is serious in nature. There are specific allegations
against the husband of the deceased regarding ill­treating her about not
being able to retain her pregnancy. Investigation is still in progress and
charge­sheet is yet to be filed. In view thereof, I am inclined to partly allow
the application in terms of the following order:
ORDER

Application is hereby partly allowed.

Application is rejected as far as applicant No.1 is concerned and
allowed as far as applicant No.2 is concerned.

Applicant No. 2 Govind Ganga Sohale be released on bail by
executing P.R. and S.B. of ₹30,000/­ with one or two local
sureties of like amount.

Applicant No. 2 shall not directly or indirectly, make any
inducement, threat or promises to any person acquainted with
the facts of accusation, so as to dissuade him/her from
disclosing such facts to the Court or to the police officer and
shall not tamper with the prosecution evidence in any manner.

Applicant No. 2 shall not commit any offence and shall attend
all dates of hearing after filing of charge­sheet.

Applicant No. 2 is duty bound to inform the I.O. and the court
about his change of address, if any.

Applicant No. 2 shall furnish residence and ID proof of two
blood relatives to the I.O.
