1.The applicant/accused Kiran Somnath Gotarne claims bail in C.R. No. I247/2022 for the offences punishable under Sections 354A(4) of the Indian Penal Code and under Sections 12 of the POCSO Act registered with Mumbai Naka Police Station, Nashik.
2.Heard Learned Advocate Shri T.S.Shaikh, for the applicant and learned A.P.P. Smt. Sangale for the State. The victim is also present. Perused the papers of investigation.
Also perused the say filed by informant.
3.It is the case of the prosecution that the applicant 30 years old person, outraged the modesty of minor girls of tender age.
4.On perusal of record, it reveals that the applicant and informant has no direct concern, enmity etc. There are specific allegations against the applicant that he uttered offending obscene words to the tender age girls on two different dates.
Such an act of the applicant indicates his pervert mind.
Considering the prima facie averments in the report as well as police papers, it appears that applicant has habit to commit such immoral act. Nowadays, it appears that even children of tender age are not spared in pursuit of pervert lust.
5.Overall prima facie record reflects the concern of applicant with alleged serious and henious offence.
Investigation is at premature stage. Thorough investigation is required to be done. If the applicant would be released on bail, there is every possibility that he may pressurize the witnesses and tamper with prosecution evidence. Therefore, this Court is of the considered view that the applicant is not entitled for grant of bail. Hence, the order.
