The
applicant/accused Kedar Dashrath Handore
claims bail in C.R. No. I­04/2022 for the offences punishable
under Sections 376(2)(j)(n), 366­A, 114 of the Indian Penal Code
and under Sections 4, 8 & 12 of the POCSO Act registered with
MIDC Police Station, Sinnar.

Heard Learned Advocate Shri S.R.Borade, for the
applicant and learned A.P.P. Smt. Jadhav for the State. The
victim is also present. Perused the papers of investigation.

It is the case of the prosecution that applicant
induced the minor victim, kidnapped her and then, had sexual
relations with her without valid consent.

On perusal of record, it reveals that missing report
was lodged by the father of victim that his daughter left the
house without giving intimation to anyone and was not found
though they searched for her in the vicinity.

It is mentioned in
the report itself that informant was aware about the friendship
between minor victim and the applicant.

Thus, from the
averments in the report, it becomes clear that victim has left her
house on her own.

Learned Advocate for the applicant
submitted that victim eloped with the applicant out of love­
affair. Record reflects that there are no any other allegations as
to violent act committed by the applicant against the victim.

Howsoever it may be, it reveals from record that
applicant came to be arrested on 22.05.2022. There is no any
recovery or discovery
as such remained from the applicant.

According to ld. Advocate for the applicant, the applicant has no
criminal antecedents. He is a young boy of 23 years old. He is a
local resident and is ready to abide any conditions on grant of
bail. Considering all these aspects, this Court is of the view that
applicant can be released on bail by imposing certain conditions.
Hence the order.

c] Applicant is directed to furnish his
permanent address proof, mobile number.
