ORDER BELOW EXH.1
This is an application filed under Section 439 of the Criminal
Procedure Code for offence punishable under Section 4/25 of the
Arms Act and 135 of the Bombay Police Act in C.R.No.126/2022 of
Sarkarwada Police Station.

Facts of the prosecution case are as follows ­
That accused found with the sickle and chopper alongwith
co­accused which is prohibited under the Arms Act and despite of
prohibition order in existence.

Applicant come with the case that he falsely implicated in this
case. His whole family is dependent on him. He is ready to abide any
condition.

Heard both side. Perused application and say.

It is submitted by the Ld. APP Smt. Patil that there are no
criminal antecedence against the accused whereas co­accused
released on bail. In considering rule of parity I am of the opinion that
he is entitled for the bail. Hence, order ­
ORDER
1.

Bail Application below Exh.1 is allowed.

2.

Applicant/accused be released on bail in C.R.
No.126/2022 registered with Sarkarwada Police
Station for an offence punishable under Sections­
4/25 of the Arms Act and 135 of the Bombay
Police Act on furnishing P. R. Bond of Rs.15,000/­
with one surety in like amount on following
conditions.
(a) He shall attend Concern Police Station on First
and Third Monday in between 11.00 a.m. to
2.00 p.m. till filing of charge­sheet.
(b) Applicant/accused shall submit his contact
numbers and proof in respect of permanent
and temporary residence to this Court.

3.

Criminal Bail Application stands disposed of
accordingly.
