{ Hari Laxman Pimpale Vs. State }
This is application under section 439 of the Criminal
Procedure Code for grant of bail pending trial.

The present application is moved by the applicant
accused praying to release him on bail in connection with the CR
No.123/2022 registered with Vavi Police Station under section 379,
420,465,467,468,471 r/w sec. 34 of the Indian Penal Code and
section 48/7 of Maharashtra Land Revenue Code, 1966.

It is stated in the application that, alleged incident took
place on 31.5.2022 accused has committed theft of sand and
allegedly used the forged permit No.373 at column No.6 by
overwriting in it, for carrying sand from Manjur, Tal. Kopargaon,
Dist. Ahmednagar from the river. It is also stated in the FIR that
permit was on the name of Jadhav Building Supply, Chasnali, Tal.
Kopargaon. Accused was arrested on 1.6.2022 and remanded to
Magisterial custody and since then he is in jail.

Perused the record. Heard, both parties.

The learned counsel Shri. N.B. Gangavane submitted
that antecedents of the accused are clean, no purpose will be served
by keeping him behind the bar. I.O. is absent. He has submitted his
report and objected the bail. On perusal of the record, it appears
that the offences are nonbailable and triable by learned Magistrate.
The Highva/Truck was seized by the police already recovered, the
other part of investigation is on the basis of documents and
therefore, there is no need of applicantaccused with police for

further investigation. He is local resident. He is driver. No purpose
will be served by keeping him behind the bar. Considering the
above said fact, applicantaccused is entitled for bail with certain
conditions. Hence, following order is passed.
ORDER
1.
Application is allowed.
2.
Applicantaccused Hari Laxman Pimpale in No.123/2022
registered with Vavi Police Station under section 379,
420,465,467,468,471 r/w sec. 34 of the Indian Penal Code
and section 48/7 of Maharashtra Land Revenue Code,
1966., be released on bail on executing bond of
Rs.15,000/ with surety in like amount.

He shall not hamper or tamper with the witnesses.
4.
He shall furnish address proof aadhar card of his two near
relatives alongwith mobile numbers.
5.
He shall also furnish his address proof aadhar card with
mobile numbers.
6.
He shall attend the Vavi Police Station on every Thursday
in between 11.00 a.m. to 2.00 p.m. till filing of charge
sheet.
7.
In the event of breach of any of the conditions, their bail
bonds shall be liable to be cancelled.
8.
Bail in lower Court.
