This is an application under section 438 of Criminal
Procedure Code in Crime No. 182/2022 registered at Police
Station, Ambad,. Nashik for the offence under sections 354, 324,
143, 147, 148 & 149 of the Indian Penal Code, 1860. It is the
case of prosecution in brief that the accused/applicants (who
were working as labourers in the company where the
complainant was employed as an H.R. Manager) assaulted the
complainant’s brother with a stone and also molested her.

Ld. Adv. for the applicants has submitted that the
FIR is exaggerated.
The applicants were paid 15 days’ less
salary and were therefore upset. Later, the complainant called
them to her place which led to a dispute. The provisions of Sec.
354 of the I.P.C. have been added purely with a view to add
nonbailable sections. Custodial interrogation of the applicants
is not necessary. Applicants have complied with the terms and
conditions imposed by the Court while granting interim relief.

Per contra Ld. A.P.P. has opposed the application on
the ground that custodial interrogation of the applicants is
necessary.

Applicants have complied with the terms and
conditions imposed by the Court while granting interim relief.
Their custodial interrogation therefore does not appear to be
necessary. In view of the foregoing discussion, I am inclined to
allow the application in terms of the following order:
