This is application under section 439 of the Criminal
Procedure Code for grant of bail pending trial.

The present application is moved by the applicant­
accused praying to release him on bail in connection with the CR
No.89/2022 registered with Trimbkeshwar Police Station under
section 353, 323, 504, 506, 342, 186 of the Indian Penal Code.

It is stated in the application that, alleged incident took
place on 19.5.2022 accused has allegedly assaulted the teachers of
the school with fist and kicks and therefore, crime is registered
against him. Accused was arrested on 25.5.2022 and remanded to
Magisterial custody and since then he is in jail.

Perused the record. Heard, both parties.

The learned counsel Shri. P.R. Shejwal submitted that
he was in jail more than one month, no purpose will be served by
keeping him behind the bar. I.O. has submitted his report and
objected the bail. On perusal of the record, it appears that the
accused was arrested on 25.5.2022 and since then he is in jail.
From the FIR it is disclosed that accused had under influence of
liquor visited the office of the principal Zilla Parishad School,
Velunje, Tal. Trimbakeshwar and demanded Rs.100/­ to them. The
applicant­accused disturbed the schedule meeting and assaulted
one of the teacher Deonath Rajaram Potinde. The staff members of
the school intervened the matter and drove the accused from the
room, however the accused had locked them from the outside and

therefore, the staff members and teachers were wrongfully confined
in the room. The applicant­accused created scene in the school by
abusing and threatening. The police van came in the school and
applicant­accused ran away from the spot.

Thus, it appears that, the accused misbehaved under the
influence of liquor. However, I.O. submitted that most of the
investigation is completed and charge­sheet will be filed in the
court within 15 days and therefore, considering the fact that
applicant­accused is in jail since 25.5.2022, his bail application can
be allowed with certain conditions. Hence, following order is
passed.
ORDER
1.

Application is allowed.

2.

Applicant­accused Gopal Madhukar Ughade in connection
with the CR No.89/2022 registered with Trimbkeshwar
Police Station under section 353, 323, 504, 506, 342, 186
of the Indian Penal Code, be released on bail on executing
bond of Rs.30,000/­ with one or two surety in like amount.

He shall not hamper or tamper with the witnesses.

4.

He shall furnish address proof aadhar card of his two near
relatives alongwith mobile numbers.

5.

He shall also furnish his address proof aadhar card with
mobile numbers.

6.

He shall attend the Trimbakeshwar Police Station on every
Thursday in between 11.00 a.m. to 2.00 p.m. till filing of
charge­sheet.

7.

In the event of breach of any of the conditions, their bail
bonds shall be liable to be cancelled.
