This application has been filed by the applicants/accused
under section 438 of Cr.P.C. for releasing them on anticipatory bail
in the event of their arrest in the aforesaid Crime registered at
Bhadrakali Police Station, Nashik for the offence punishable under
sections 498­A, 323, 504, 506 r/w. 34 of the Indian Penal Code and
accordingly
interim
protection
was
granted
to
applicants
on
29.07.2022.

Heard Smt. Deepali A. Ahire learned Advocate for
applicants and learned APP Smt. Jadhav. IO is absent.

It is the case of the prosecution that the applicants being
husband and in­laws of the informant, have illtreated and harassed
her for unlawful demand.

Learned Advocate for the applicants submitted that the
informant is residing at her parental house since April 2021. She has

lodged report on 26.07.2022.

There is no any reason as to delay in
lodging report. Moreover, it is pointed out that applicants No.2 and 3
are resident of Ahamadnagar.

They do not have direct concern with
applicant No.1 and his wife/informant.

Prima faice it appears that
the applicant No.1 and informant had marital dispute.

Delay in
lodging report prima facie create doubt about its veracity. On these
amongst ground, interim bail was granted to applicants on 29.07.2022.
IO is absent and no say is filed by the IO.

The ld. APP took formal
objections to the application.

As per the contention of ld. Advocate for the applicants,
the applicants have no criminal antecedents. They are ready to abide
any conditions imposed upon them. Therefore, considering all these
aspects, this Court is of the view to confirm the interim protection
granted to applicants. Hence, the order.
