ORDER BELOW EXH.1

1] This bail application is filed u/s.439 of Cr.P.C. in CR No.200/2022 for the offence punishable u/s.379 of Indian Penal Code registered at Dindori Police Station.

2] The case of the prosecution is that informant Bhausaheb Bagul lodged complaint on 7.11.2021. On 7.11.2021 in between 22.30 hours to 6 a.m. of 8.11.2021 at Jaulke Dindori, Tal. Dindori, Dist.Nashik he parked his Bajaj Discover Motorcycle No.MH-15-DN-4397 worth Rs.18,000/- which was stolen by the accused without consent. According offence registered under Section 379 of the I.P.C.

3] The case of the applicant is that he is falsely implicated.

He is only earning member of his family. He has not stolen the motorcycle. He is in jail for more than one and half month.

4] I have heard Adv.Shri.Walke for the accused and Ld. APP Shri.Kadave for the state.

5] Perused application and say. I reveals after perusal of the say filed by the prosecution that accused is habitual offender in commission of theft of motorcycle vehicles. It is to be noted that he is implicated in one offence in 2018, two offences in 2019, seven offence in 2021 and remaining 21 offences in 2022. So, approximately 31 offences of theft has been registered at Hingoli District P.S., Ahamadnagar District P.S., New Bombay District P.S., Pune City P.S. Pune District Rural P.S., Pimpari Chinchwad P.S.. It is very serious one. Ld. Adv. Shri.Walke placed reliance Sri Sandeep Reddy Vs. State of Karnataka in Criminal Petition No.5740/2022.

The citation on which he placed reliance are not applicable to the case in hand as having different footing. If he released on bail before filing charge-sheet chance to hamper the prosecution evidence and as well as considering the safety and security of property of general people in these districts, I am of the considered opinion that he is not entitled for the enlargement on the bail. Hence, order –

O R D E R

1) Bail Application below Exh.1 is rejected being devoid of merits.

2) Criminal Bail Application accordingly disposed off.
