for the applicants. There is no F.I.R. But the
applicants received notice u/s. 160 of Cr.P.C. from Mhasrul police
station for inquiry on the complaint of informant. As such there is
reasonable apprehension of arrest to the applicants.

Learned Adv. for the applicants submitted that the
applicant No.1 and informant has marital dispute on account of
alleged extra marital affair of the informant. Copy of WhatsApp chat
between informant and applicant No.1 is produced on record to that
effect. Applicant No.1 has filed divorce petition against the informant
on 29.04.2022. The other applicants do not have any concern with the
marital dispute between applicant No.1 and informant.

Admittedly report is not yet lodged. But considering the
notice issued by the Police to the applicants and background facts of
the marital dispute
between the parties, it appears that there is

reasonable apprehension to the applicants of arrest in cognizable
offences.
Applicants do not have criminal antecedents.
Hence,
considering nature of accusation and investigation thereof following
order is passed.
ORDER

Concern I.O. is directed to issue notice to the
applicants prior to 72 hours of arrest in case of
lodging of F.I.R.

Application is disposed of accordingly.
