The
applicants/accused Durgabai Santu Medage,
Santu Bhika Medage & Manoj Santu Medage claim bail in
C.R. No. I­138/2022 for the offences punishable under Sections
306, 498­A r/w. 34 of the Indian Penal Code registered with
Gangapur Police Station.

Heard Learned Advocate Shri A.K.Kale, for the
applicant, learned A.P.P. Smt. Jadhav for the State. Perused the
papers of investigation.

It is the case of the prosecution that the applicants
being in­laws of the deceased, illtreated her for unlawful demand
and thereby abetted the commission of suicide by her.

On perusal of record, it reveals that the deceased got
married with accused No.1 in the year 2011.

There are specific allegations against accused No.1
that he has consistently harassed the deceased for unlawful
demand.

But there are no specific allegations against the
applicants.

General allegations are made that since the
marriage, deceased Shilpa suffered harassment at the hands of
in­laws. Learned Advocate for the applicants submitted that the
applicants were residing separately from accused No.1 and the
deceased.

They have no concern with the marital relations of
accused No.1 and the deceased.

It reveals from the record that applicants No.1 and 2
are aged persons.

All the applicants came to be arrested on
05.07.2022. There is no recovery or discovery as such remains
from the applicants. Physical custody of the applicants is thus no
more required. Learned Advocate for the applicants submitted
that the applicants do not have any criminal antecedents. They
are local resident and are ready to abide any condition on grant
of bail.

Considering all these aspect, this Court is of the view
that applicants can be released on bail by imposing certain
stringent conditions. Hence, the order.

one surety in the like amount subject to
following conditions :­
a] That they shall not tamper with
prosecution evidence in any manner.

c] Applicants are directed to furnish their
