Order below Exh. 1 in Criminal Bail
Application No. 1339/2022.

This is an application moved by the applicant/accused Dilip
Bhalchandra Dongre under section 439 of the Code of Criminal Procedure
in C.R.No. I­163/2022 registered against accused at Satpur Police Station
for the offence punishable under sections 364­A, 384, 386 r/w section 34
of the Indian Penal Code.

It is submitted by the accused that he has no concern with the
offence. Nowhere the complainant has stated that the person who came
to the office is the accused. As the applicant is the father­in­law of the
deceased daughter of the complainant and to harass him he has been
involved in the present crime. Nothing has to be recovered from him. Co­
accused Ramkrishna Dinke has been released on bail. He is ready to abide
by the terms and conditions. Hence, prayed to allow the application.

Say was called of the investigating officer. He has objected
this application on the count that, the offence is serious. Share of the
extorted amount has been spent.

Ertiga vehicle, two mobiles of the
complainant and the knife was to be recovered. Co­accused are yet to be
arrested. The offence is technical in nature. Accused is habitual offender
against whom 6 offences are registered. He is aware of the residence of
the complainant. There is every possibility he will threaten and commit
serious offence. Hence, prayed that application be rejected.

Heard Ld. APP and Ld. Advocate for accused in detail. They
have submitted as per their application and say. Though it is contended by
the Advocate for the accused that co­accused has been released on bail.
On perusing the order it is seen that he was not facing allegations that he
abducted the informant and the role played by him that Crypto currency
was transferred in his account and in those circumstances bail was granted
to him. However, on perusing the role played by the present applicant it
is seen that he is in receipt of his share from the extorted amount. Even
investigation is in progress as mobile, vehicle and knife used in the offence
are yet to be recovered. Co­accused are yet to be arrested. There is every
possibility that if accused is released on bail he will threaten the
complainant.

As the investigation is in progress I am not inclined to
release accused on bail. Hence, I proceed to pass the following :­
ORDER
Application is hereby rejected.
