Dhangar claims bail in C.R. No. I­68/2022 for the offences
punishable under Sections 306, 498­A, 323, 504 r/w. 34 of the
Indian Penal Code registered with Mhasrul Police Station.

Heard Learned Advocate Shri A.J.Bhide, for the
applicant, learned A.P.P. Smt. Jadhav for the State. Perused the
papers of investigation.

It is the case of the prosecution that applicant being
husband of the deceased illtreated her with cruelty and thereby
abetted and instigated the commission of suicide by her.

Learned Advocate for the applicant submitted that
this is the first bail application filed by the applicant.

Now,
charge­sheet is filed and thereby investigation is complete. Wife
of the applicant committed suicide on 03.05.2022.

He has
produced photographs of the applicant and his wife which reflects
their happy cohabitation.

01.04.2022 for the trip of applicant and his wife.

Learned
Advocate for the applicant also produced family photographs
wherein deceased appears to be very happy with her in­laws
especially mother­in­law against whom there are allegations of
cruelty.

It is further submitted that the mother­in­law of
deceased is also an accused but she is not arrested. Deceased has
committed suicide at her maternal house. Therefore, according
to learned Advocate for applicant that there is no direct nexus of
applicant with the act committed by deceased.

Howsoever it may be, record reflects that applicant
came to be arrested on 09.05.2022. Now, charge­sheet has been
filed and thereby investigation is complete.

There is no any
recovery or discovery as such remains from the applicant.
Physical custody of the applicant is thus no more required.
Learned Advocate for applicant submitted that the applicant has
no criminal antecedents. He is ready to abide any conditions on
grant of bail.

Considering all these aspect, this Court is of the

view that applicant can be released on bail by imposing certain
stringent conditions. Hence, the order.

Applicant­Accused Dhananjay Santosh
Dhangar arrested in C.R. No. I­68/2022 for
the offences punishable under Section 306,
498­A, 323, 504 r/w. 34 of the I.P.C.
registered with Mhasrul Police Station, be
released on bail in the sum of Rs.15,000/­
(Rupees Fifteen Thousand only) with one or
two sureties in the like amount subject to
following conditions :­
a] That he shall not tamper with
prosecution evidence in any manner.

witness and interfere with the investigation
in any manner.
c] Applicant is directed to furnish his
permanent address proof, mobile number.
