The
applicant/accused Devendra Rajaram Wagh
claims bail in C.R. No. I­115/2022 for the offences punishable
under Sections 363 & 376 of the Indian Penal Code and under
Sections 4 & 8 of the POCSO Act registered with Adgaon Police
Station.

Heard Learned Advocate Shri A.K.Kale, for the
applicant and learned A.P.P. Smt. Sangale for the State. Perused
the papers of investigation.

It is the case of the prosecution that applicant has
induced minor victim, kidnapped her and thereafter sexually
ravished her.

On perusal of record, it reveals that the report is
lodged by the father of victim that on 11.05.2022, victim left the
house without giving intimation to anyone. Thus, prima facie, it
reveals that the victim who is 17 years old at relevant time, left
her house on her own.

She was found in the custody of
applicant­accused.

Ld. Advocate for the applicant submitted that the
victim insisted applicant to go with her, otherwise, she would
commit suicide. They were engaged in love­affair. There are no
allegations as to violent act committed by the applicant against
the victim.

The present applicant is a young boy of 20 years old.

He came to be arrested on 29.05.2022. There is no any recovery
or discovery as such pending against the applicant.

According
to ld. Advocate for the applicant, applicant has no criminal
antecedents.

He is a local resident and is ready to abide any
conditions on grant of bail.

Considering all these aspects, this
Court is of the view that applicant can be released on bail by
imposing certain conditions. Hence the order.

with a surety in the like amount subject to
following conditions :­
a] That he shall not tamper with
prosecution evidence in any manner.

area/vicinity where the victim resides till end
of trial.
