1. The applicant/accused Chandrashekhar Vilas Donde claims bail in C.R. No. I­223/2022 for the offences punishable under Sections 305, 384, 504, 506, 509 of the Indian Penal Code and under Sections 12(a) of the POCSO Act registered with Nashik­Road Railway Police Station, Nashik­ Road.

2.Heard Learned Advocate Shri A.C.Pradhan, for the applicant and learned A.P.P. Smt. Sangale for the State. The victim is also present. Perused the papers of investigation.

3.It is the case of the prosecution that applicant induced deceased and used to extract money from her. To extract money, he used to threaten her to defame and thereby abetted the commission of suicide by the deceased.

4.On perusal of record, it reveals that there are specific allegations against the applicant that he used to send messages to the deceased and extract money from her. He has pressurized her to give him money, thereby deceased Sakshi committed suicide. Apparently, deceased died due to injuries sustained in Railway accident. Whether it was suicide or accidental death would be the subject matter of trial.

Considering the averments in the report prima facie concern of the applicant with alleged offence becomes clear.

5.Howsoever it may be, it reveals from record that applicant came to be arrested on 08.08.2022. Now, charge­sheet is filed by the investigating officer. There is no any recovery or discovery as such remain from the applicant. According to ld.

Advocate for the applicant, the applicant has no criminal antecedents. He is 22 years young boy. He is ready to abide any conditions on grant of bail. Considering all these aspects, this Court is of the view that applicant can be released on bail by imposing certain conditions. Hence the order.

2]Applicant­Accused Chandrashekhar Vilas Donde arrested in C.R. No. I­223/2022 for the offences punishable under Sections 305, 384, 504, 506, 509 of the Indian Penal Code and under Sections 12(a) of the POCSO Act registered with Nashik­Road Railway Police Station, Nashik­Road be released on bail in the sum of Rs.15,000/­(Rupees Fifteen Thousand only) with a surety in the like amount subject to following conditions :a] That he shall not tamper with the prosecution evidence in any manner.

b] Applicant is directed attend the trial regularly.

c] Applicant is directed to furnish his permanent address proof, mobile number.
