applicant/accused

Shewale claims bail in C.R. No. 126/2022 for the offences
punishable under Sections 354­D, 376, 376((1)(2)(i)(n),(3) of the
Indian Penal Code and under Sections 4, 6, 8 of the POCSO Act
registered with Mhasrul Police Station, Nashik.

Heard Learned Advocate Shri M.D.Bhanose, for the
applicant and learned A.P.P. Smt. Aparna Patil for the State.
The Victim is also present before the Court. Perused the papers
of investigation.

It is the case of the prosecution that the applicant
induced minor victim and thereby sexually ravished her on time
to time.

On perusal of record, it reveals that applicant is a
young boy of 21 years old and the victim is near about 15 years
old.

There is no any documentary evidence on record to prima
facie show the age of the victim.

applicant produced copies of Whats­App chat between the
applicant and minor victim which reflects that both of them were
engaged in love affair. The applicant has not committed any
violent act against minor victim.

Howsoever it may be, it reveals from record that
applicant came to be arrested on 02.08.2022. There is no any
recovery or discovery
as such remained from the applicant.

According to ld. Advocate for the applicant, the applicant has no
criminal antecedents. He is 21 years old boy. He is a local
resident and is ready to abide any conditions on grant of bail.
Considering all these aspects, this Court is of the view that
applicant can be released on bail by imposing certain conditions.
Hence the order.
