Heard Ld. Advocate Mr. V.R.Deshpande for the applicants. There is no F.I.R.
But the applicants were called at Police Station for inquiry.
2] Admittedly report is not yet lodged. Learned Advocate for the applicants produced certain documents i.e. bail order passed on the application filed by informant in Cr.B.A.No.1039/2022 and copies of reports filed against each other. There are case and counter case filed by both the parties against each other. The applicants have also produced medical papers that they have also sustained injuries during the occurrence. Considering all these documents and the controversy between the parties, apprehension expressed by the applicants cannot be said to be out of place.
3] Learned Advocate for the applicant submitted that the applicants are local resident and are ready to abide any conditions on grant of relief. Hence, considering nature of accusation and investigation thereof following order is passed.

1] Application is partly allowed.
2] Concern I.O. is directed to issue notice to the applicants prior to 72 hours of arrest in case of lodging of F.I.R.
3] Application is disposed of accordingly.
