ORDER BELOW EXH. No.1
(Delivered on 07 th April, 2022)
1.Read the application and the say filed by the respondent vide Exh.5. Heard Ld. Advocate for the applicant and Ld. A.P.P. for the State. Perused the policepapers produced for inspection by the I.O., who is present in the Court.
2.Crime No.I67/2022 stood registered against the applicant at respondent/police station for an offence punishable under Section 353 and 332 of the Indian Penal Code, for an allegations that, while applicant was quarreling in front of the Police Station, near medical store at that time the complainant intervene to maintain law and orders. At that time, applicant slapped him on his left side of the face and injured and obstructed him from discharging his official duties.
3.It is the case of the applicant that, he is an innocent, mistakenly the complainant got hurt, applicant is ready to abide by the terms and conditions and investigation is completed. Therefore, prayed to allow the application.
4.Respondent objected on the ground of ongoing investigation, Statements under Section 164 of Cr.P.C. are to be recorded of the witnesses, there is likelihood that, the applicant may threatened the witnesses. may pressurize the witnesses. Therefore, prayed to reject the application.
5.Upon hearing and going through the material placed on record, what can be gathered is that, the incident occurred on 24.03.2022 and applicant was arrested and produced before the Ld.
J.M.F.C. on 25.03.2022 and since then the applicant is in custody. Perusal of the policepapers reflects that, investigation is on the verge on the completion. For recording the Statements under Section 164
of Cr.P.C., applicant need not be in custody. By imposing certain conditions, the applicant can be admitted to bail. In the result, the application succeeds. Hence, the order.
O R D E R
1.Criminal Bail Application No.416/2022 is allowed.
2.Applicant Arun Sakharam Bansode be released on bail in connection with C.R. No.I67/2022 registered with the respondent Satpur Police Station for an offence punishable under Sections 353 and 332 of the Indian Penal, on his executing a personal bond of Rs.15,000/ with one solvent surety in like amount to the satisfaction of the concerned Ld. J.M.F.C., Nashik.
3.Applicant not to threaten and pressurize the complainant and the witnesses.
4.Applicant not to tamper with the prosecution evidence.
5.Applicant not to commit similar offence in future.
6.Bail before the Ld. J.M.F.C., Nashik.
7.In above terms, the Criminal Bail Application No.416/2022 stands disposed off accordingly.
