The applicant/accused Ankit Sing Tribhuvan Sing
claims bail in C.R. No. I­228/2022 for the offences punishable
under Sections 354­D, 506 of the Indian Penal Code and under
Sections 12 of the POCSO Act registered with Panchavati Police
Station, Nashik.

Heard Learned Advocate Shri Y.D.Ugale, for the
applicant and learned A.P.P. Smt. Jadhav for the State. Victim is
present before the Court. Perused the papers of investigation.

It is the case of the prosecution that applicant
facilitated the commission of offence of outraging modesty of
minor victim by accused No.1.

On perusal of record, it reveals that there are no
specific allegations in the report against the applicant.

Merely,
it is averred that he had been with the main accused at the time
of alleged incident.

As such prima facie no role is attributed to
the accused in commission of alleged offence.

It reveals from record, applicant came to be arrested
on 24.06.2022. There is no any recovery or discovery as such
remained from the applicant. According to ld. Advocate for the
applicant, the applicant is local resident and is ready to abide
any conditions on grant of bail.

Considering all these aspects,
this Court is of the view that applicant can be released on bail by
imposing certain conditions. Hence the order.

Sing arrested in C.R. No. I­228/2022 for the
offences punishable under Section 354­D &
506 34 of the I.P.C. and under Section 12 of

Police Station, Nashik be released on bail in
the sum of Rs.15,000/­(Rupees Fifteen
Thousand only) with a surety in the like
amount subject to following conditions :­
a] That he shall not tamper with
prosecution evidence in any manner.
