This application has been filed by the applicants/accused
under section 438 of Cr.P.C. for releasing them on anticipatory bail
in the event of their arrest in the aforesaid Crime registered at
Dindori Police Station, for the offence punishable under sections 498
A, 406 r/w. 34 of the Indian Penal Code and accordingly, interim
protection was granted to applicants by this Court on 28.06.2022.

Heard Learned Advocate Shri Gadekar, for the applicants
and learned A.P.P. Smt. Jadhav for the State. IO is also present.
Perused the papers of investigation.

It is the case of the prosecution that the applicant No.1
being the husband and other applicants being inlaws and relatives of
the husband of informant, have illtreated and harassed the informant.

On perusal of record, it reveals that, the marriage of
informant and applicant No.1 was solemnized on 04.04.2013. It was
love marriage.
Admittedly, since beginning informant and applicant

No.1 started residing separately.

Ld. Adv. for the applicants
submitted that other applicants have no concern with the marital
affairs between informant and applicant No.1. It is further pointed
out that the applicant No.1 has filed marriage petition No.243/2022
before Civil Judge, Sr. Division,
Khed, Rajgurunagar, Pune.
Thereafter as a counter blast, informant lodged this report.
Considering all these documents and the contentions putforth by the
applicant, it appears that dispute between the parties is purely
marital one.
On these amongst grounds, interim bail was granted to
the applicant on 28.06.2022.
Now, say is filed by the IO and the
formal objections are raised. It appears that the applicant cooperated
the investigation.

As per the contention of ld. Advocate, the applicants have
no criminal antecedents. They are local resident and they are ready to
abide any conditions imposed upon them. Therefore, considering all
these aspects, this Court is of the view to confirm the interim
protection granted to applicants. Hence, the order.
