This is application under section 439 of the Criminal
Procedure Code for grant of bail pending trial.

The present application is moved by the applicants­
accused praying to release them on bail in connection with the CR
No.102/2022 registered with Trimbkeshwar Police Station under
section 353,341,332,504,506 r/w sec. 34 of the Indian Penal Code.

It is stated in the application that, alleged incident took
place on 2.6.2022 accused have allegedly assaulted the ST driver by
Tomy and iron rod and therefore, crime is registered against them.
Accused were arrested on 6.6.2022 and remanded to Magisterial
custody and since then they are in jail.

Perused the record. Heard, both parties.

The learned counsel Shri. A.K. Kale submitted that
antecedents of the accused are clean, no purpose will be served by
keeping them behind the bar. I.O. has submitted his report and
objected the bail. On perusal of the record, it appears that T.I.
parade of the accused is already over. The weapons used in the
alleged crime are already recovered. The accused are local resident.
No purpose will be served by keeping them behind the bar.
Considering the above said fact, applicants­accused are entitled for
bail with certain conditions. Hence, following order is passed.

ORDER
1.

Application is allowed.

2.

Applicants­accused No.1 Akash Gopala Ambhore,
No.2
Atul Ruprao Sejwal and No.3 Ravindra Maruti More
in
No.102/2022 registered with Trimbakeshwar Police Station
under section 353,341,332,504,506 r/w sec.34 of the
Indian Penal Code, be released on bail on executing bond
of Rs.15,000/­ each with surety in like amount.

They shall not hamper or tamper with the witnesses.

4.

They shall furnish address proof aadhar card of their two
near relatives alongwith mobile numbers.

5.

They shall also furnish their address proof aadhar card with
mobile numbers.

6.

They shall attend the Trimbakeshwar Police Station on
every Thursday in between 11.00 a.m. to 2.00 p.m. till
filing of charge­sheet.

7.

In the event of breach of any of the conditions, their bail
bonds shall be liable to be cancelled.

8.

Bail in lower Court.
