This application has been filed by the applicants/accused
under section 438 of Cr.P.C. for releasing them on anticipatory bail
in the event of their arrest in the aforesaid Crime registered at Ghoti
Police Station, for the offence punishable under sections 498­A, 323,
504, 506 r/w. 34 of the Indian Penal Code.

Heard Learned Advocate Shri J.N.Shinde, for the
applicants and learned A.P.P. Smt. Sangale for the State. IO is
also present. Perused the papers of investigation.

It is the case of the prosecution that the applicant No.1
being the husband and other applicants being in­laws and relatives of
the husband of informant, have illtreated and harassed the informant.

On perusal of record, it reveals that, the report came to be
lodged on 17.05.2022.

There are allegations that the accused
harassed her for unlawful demand till 17.05.2022.

Report reflects
that informant left the house of applicants on 05.03.2021. Since then,
she is residing with her parents.

She has mentioned that they

attempted to compromise the matter but it was not settled.

There is
much delay in lodging report which is not explained by the informant.
Dispute between the parties appears to be purely marital in nature.
Say is filed by the IO and the formal objections are raised.

As per the contention of ld. Advocate, the applicants ha ve
no criminal antecedents. They are ready to abide any conditions
imposed upon them.

Therefore, considering all these aspects, this
Court is of the view to allow the application and released the
applicants on anticipatory bail. Hence, the order.

In the event of arrest of the applicants – Ajay
Chhagan Wadekar, 2) Nirmala Chhagan
Wadekar, 3) Chhagan Laxman Wadekar, 4)
Sandeep Chhagan Wadekar, 5) Sangeeta
Subhash Lavhale, 6) Sarita Prakash Lavhale
and 7) Prakash Chiman Lavhale in Crime No.I­
68/2022 of Ghoti Police Station for the offences
punishable under sections 498­A, 323, 504 and
506 r/w. 34 of IPC, they be released on ad­
interim anticipatory bail in sum of Rs.15,000/­
each (Rupees Fifteen Thousand only) with a
surety in the like amount subject to conditions
that :­
a] That the applicants shall make themselves
available for interrogation by the Investigation
Officer as and when required under written
intimation.

b] The applicants shall not directly or indirectly,
make any inducement, threat or promise to any
person acquainted with facts of accusation, so as
to dissuade them from disclosing such facts to
the Court or to any Police Officer.
