Order Below Exh.1 in Cri. Bail Appln.No.564/2022
CNR No.MHNS010022912022
Abhishek Ashok Khandge Vs. State.
Heard:
1.
Ld. Adv. Mr. S. J. Deshpande for the applicant/
accused.
Ld. A.P.P. Ms. S. S. Sangle for the State.
This is an application under Section 439 of the Code of
Criminal Procedure in Crime No.95/2022 registered at Wavi Police
Station, Dist. Nashik for the offence under Section 305 of the Indian
Penal Code. It is the case of prosecution in brief that the
accused/applicant told the 15 yearold minor victim that he loves her
and that he will commit suicide if she does not love him back. The
victim committed suicide due to the said reason by consuming
insecticide.
2.
Ld. Adv. for the applicant has submitted that no such
case of abetting the suicide of a minor has been made out. There was
no harassment at the instance of the applicant who is only 19 years
old and is a student of I.T.I. He has filed his admission receipt on
record. Applicant is ready to abide by the terms and conditions
imposed by the Court. Material part of the investigation is over.
3.
Per contra, Ld. A.P.P. has opposed the bail application
on the ground that there is primafacie case against the applicant. If
he is released on bail, there are chances of his tampering with
prosecution witnesses.
4.
Material part of the investigation is over. Applicant is
ready to abide by the terms and conditions imposed by the Court.
