ORDER
1.
In this application accused Yusufbhai Ahemadbhai Patel is asking
for regular bail under Section 439 of Cr.P.C. He submitted that he has been
falsely implicated. He is not concerned with the offence. Therefore, he may
be granted regular bail.

From the report of IO/APP, it appears that the offence vide CR
No.157/2020 is registered at Bangur Nagar Police Station. The said
offences are punishable under Section 379, 201, 411, 413, r/w. 34 of the
IPC. The report further disclose that three accused have already arrested

and released on bail in the year 2020. Chargesheet is also filed against
them. Now, it is the objection that if this accused is released on bail then
he will tamper evidence and will abscond. There is one more ground of
objection about this accused that he is resident of Gujrat State and
therefore, if accused is released on bail, it will be difficult to secure his
presence. The report disclose that the offence punishable under Section
413 is triable by Sessions Court. Already coaccused are released on bail.
The ground of objection can be secured by imposing conditions. The
objection that he is Resident of Gujrat is not sufficient to reject the bail of
the accused. Therefore, considering filing of chargesheet, release of co
accused on bail, I proceed to pass following order:
ORDER
1. Bail Application No. 1579/2022 is allowed.
2. Applicant/accused Yusufbhai Ahemadbhai Patel be released on bail on
his executing PR bond of Rs.25,000/ (Rupees Twenty Five Thousand)
with one or two sureties of like amount.
3. Applicant shall not tamper prosecution evidence in any manner.
4. Thus, Bail Application No. 1579/2022 stands disposed of.
