ORDER
1.

This is an application under section 439 of Cr.P.C. for bail by
applicants/accused in crime No.9/2022 under section 307,386,387,
143,144,148,149, of IPC and section 3,4,25 & 27 of Arms Act r/w
section 37(1) (a),135 of Maharashtra Police Act, registered at police
station Deonar, Mumbai.

Order
Mr. Vishal A. Bhogle Advocate for applicant/accused has
submitted that applicant is innocent and she has not committed any
crime. The injured was treated as an OPD patient. Charge­sheet is filed.
Now custodial interrogation of the accused is not necessary. Hence, he
prayed to release the applicant/accused on bail.

Mr. Ramesh Siroya, APP for the State has submitted that offence
is serious, and if the accused is released on bail then she will pressurize
the witnesses. He prayed to reject the application.

I have perused the charge­sheet. It is alleged that accused
forcibly recovered “Hafta” from the shop owners in the area.
Complainant’s father runs shop in the said area and accused had
recovered Hafta from him. The incident occurred on 4/1/2022 and
5/1/2022. The allegations against the accused is that accused caused
injury to witnesses.

However, in the present case, investigation is
completed and charge­sheet is filed. Further custody of accused is not
necessary. Therefore, considering the facts and circumstances of the
case, I find that applicant/accused is entitled for bail. Therefore,
following order.

ORDER
1.

Bail Application No. 876/2022 is hereby allowed.

2.

Applicant/accused namely Yasmin Shahbaz Rubab Sayyed,
in C.R.No.9 of 2022 registered with Deonar police station
for the offence punishable under Sections 307,386,387,
143,144,148,149, of IPC and section 3,4,25 & 27 of Arms

Order
Act r/w section 37(1) (a),135 of Maharashtra Police Act ,
shall be released on her executing PR Bond of Rs.25,000/­
(Twenty Five Thousand only) with one or more sureties of
the like amount on the conditions that :­
a)
She shall attend the dates of hearing regularly unless
exempted by the court.

She be released on provisional cash bail of Rs.25,000/­.
Duration of provisional cash bail shall be for four weeks.

4.

Bail Application No. 876/2022 is disposed of accordingly.
