ORDER

This is an application U/s.439 of Code of Criminal
Procedure(hereinafter referred to as “Cr.P.C.) for the grant of bail to
the applicant Velaram Valji Patel in C.R.No.3 of 2022 of Railway

Protection Force, Borivali for the offence punishable U/s.3 of
Railway Property(Unlawful Possession) Act.

Allegation against the applicant is that he has stolen
railway scrap and sold it to co-accused Anurudh Kumar Ramfer
Mishra. Maximum punishment prescribed for the offence is three
years.

Accused
is
in
judicial
custody
since
07/04/2022.

Considering the nature of punishment and nature of offence, I am
inclined to allow the application. Hence, I pass following order.
ORDER
1
Bail Application No.864 of 2022 is hereby allowed.

Applicant Velaram Valji Patel in C.R.No.3 of 2022 of
Railway Protection Force, Borivali for the offence punishable U/s.3
of Railway Property(Unlawful Possession) Act be released on bail
on executing PR bond of Rs.25,000/- with one or more sureties of
the same amount.

Applicant to furnish his detailed address, phone number
at the time of furnishing bail.

Bail before the Court attending remand.

Applicant to attend Railway Protection Force, Borivali
on every Monday in between 11.00 a.m. to 2.00 p.m. till filing of
the chargesheet.

Applicant shall not, directly or indirectly, make any
inducement, threat or promise to any person acquainted with the
facts of the accusation against himself so as to dissuade him from
disclosing such facts to the Court or to any police officer.

Applicant shall not leave India without previous
permission of the Court.
