1.

This is an application for bail under section 439 of Cr.P.C. filed by
applicant/accused Vaseem Eliyas Ansari in C.R.No.03 of 2022, under
Sections 255, 256, 259, 260, 420, 294(A), 464, 465, 468, 472, 474 r/w 34 of
the IPC and under sections 3, 4, 5 of Prevention of Gambling Act and
under sections 4, 7(3) of Maharashtra Lottery Act, registered at crime

Facts in brief are as under :2.

P. C. Gherade was attached to crime branch on 17.01.2022. He
received secret information that accused namely Rahul Katiyar and
Wasim Ansari are running on line gambling and they transferred an
amounts in various bank accounts and also prepared bogus documents
and stamps. Accordingly police called two punchas. Police took raiding
material with them. It is alleged that raid was carried out and accused
were found in running on line gambling. Police seized fake documents
computers, printers etc., Panchnama was prepared. It is further alleged
that accused prepared the fake documents by using fake stamps.
Accordingly accused were arrested.

Police carried investigation and after completion of investigation
chargesheet is filed. Mr. Rajesh Gaikwad, advocate for accused has
submitted that accused is innocent and he has not committed any crime.
Accused has not prepared fake documents. He further submitted that
recovery is already made. Now there is no any recovery at the instance
of accused. Investigation is completed. Chargesheet is filed. Accused is
ready to abide by the conditions imposed by the Court. Hence, he
prayed to release the accused on bail.

Mr. Siroya, the learned A.P.P. for the state has submitted that
accused is habitual offender. If the accused is released on bail then he
will abscond. He prayed to reject the application.

I have perused the charge-sheet. It is alleged that accused were
running on line gambling and for that purpose they opened various fake
accounts by using fake documents and amounts received from the
business is transferred to those accounts. On the spot police seized

computer, laptop etc., Here in the present case investigation is
completed and charge-sheet is filed. Further custody of accused is not
necessary. Accused undertakes to abide by the conditions imposed by the
Court. Hence he is entitled for bail. Accordingly following order.
ORDER
1.

Bail Application No. 772/2022 is hereby allowed.

C.R.No.03 of 2022 registered with Chembur police station for the offence
punishable under Sections 255, 256, 259, 260, 420, 294(A), 464, 465, 468,
472, 474 r/w 34 of the IPC and under section 3, 4, 5 of Prevention of
Gambling Act and under section 4, 7(3) of Maharashtra Lottery Act,
shall be released on his executing PR Bond of Rs.30,000/- (Thirty
Thousand only) with one or more sureties of the like amount on the
conditions that :a)
He shall not pressurize the prosecution witnesses in
any manner.

b)
He shall not commit any offence while on bail.

c)
He shall attend the dates of Court regularly unless
exempted by the Court.

d)
He shall furnish his correct address to the
investigating officer.

He be released on provisional cash bail of Rs.30,000/-. Duration
of provisional cash bail shall be for four weeks.
4.

Bail Application No.772/2022 is disposed of accordingly.
