This is an application for bail under Section 439 of Cr. P.C.
Heard Ld. Advocate for the applicant and Ld. APP for the State. Perused
documents on record.

The Ld. Advocate for applicant submitted that applicants
are employees of Finance Company. They are falsely implicated by
police in present crime. Neither they received any amount nor
demanded any amount as extortion. It is also contended that applicants
are ready to deposit amount in the Court as allegedly received from
informant. Hence, prayed for grant of bail.

Ld. APP filed say Exh.2 and opposed the application on the
ground that investigation is in progress. If the applicants are released on
bail, they may tamper evidence of prosecution. Hence, prayed for
rejection of the application.

In view of submissions from both the sides and on perusal
of FIR, it is alleged by informant that in the month of April 2022, he
was in need of money. On searching on Internet, he came to know
about Handy Loan App. Accordingly, he download Handy Loan App on
his mobile on 2.04.2022. During that process, he entered his bank
details, Adhar Card, PAN Card and photographs. Without his demand,
amount of Rs.7,147/­ was immediately deposited in his account.
Thereafter, he received phone calls and Whats­up chats from various
persons. His photograph was morphed and he was threatened to
publish it. He was further asked to deposit amount in various accounts

within period of six days by abusing and threatening him. He was
directed to deposit amount of Rs.96,000/­. During that process, there
were some calls to his relatives and friends. His morphed photographs
were also seen to them. During investigation, it was noticed by police
that applicants are running Handy Loan App from Dharwad, Karnataka
State. Applicants were arrested and links are traced out by police. As
per allegations of informant, he paid amount of Rs.96,000/­. Applicants
shown readiness to deposit that amount in the Court. Therefore, I am of
the opinion that if the amount of Rs.96,000/­ taken by applicants
through various accounts, is deposited in the Court, they may released
on bail. Therefore, on said condition, application may be allowed.
Hence, I passed the following order :­
ORDER
1.

Criminal Bail Application No. 1626 of 2022 is allowed.

2.

Applicants No.1 Suhail Nasruddin Sayed, No.2 Ahmed Raza
Zahid Hussain, No.3 Sayed Mohammed Atahar, No.4 Mohammed
Kaif Khadri and No.5 Muftiyaz Mohammed Basha Peerzade be
released on bail on their furnishing P.R. Bond of Rs.25,000/­
along with one or two sureties of like amount each in connection
with C.R. No.02/2022 registered with Cyber Cell.

Applicants are further directed to deposit amount of Rs.96,000/­
as per submissions made during arguments.

Applicants/accused shall attend Cyber Cell on written notice of
investigator and co­operate him in investigation.

4.

Applicants/accused shall furnish their residential address proof
alongwith address and contact numbers of two close relatives to
Investigating Officer.

5.

Applicants/accused shall not directly or indirectly, make any

inducement, threat or promise to any person acquainted with the
facts of the case so as to dissuade him from disclosing such facts
to the Court or to any Police Officer.
6.

Applicants/accused shall not leave India without previous
permission of the Court.

7.

Bail before Ld. Court below.

8.

Criminal Bail Application No.1626 of 2022 stands disposed of
accordingly.
