ORDER

This is an application U/s.439 of Code of Criminal
Procedure(hereinafter referred to as “Cr.P.C.) for the grant of bail to
the applicant Sohrab Anaulmiyan Ansari in C.R.No.44 of 2021 of

West Region Cyber Police Station, Mumbai for the offence
punishable U/s.419, 420, 465, 468, 471 of Indian Penal Code
(hereinafter referred to as IPC) and
U/s.66(C), 66(D) of
Information Technology Act.

As per case of the prosecution, informant is an
authorised officer of Cyber Cell of State Bank of India. Complaints
regarding cheating were received from Twitter Handle. Therefore,
there was investigation and it was noticed that some of the
customers of State Bank of India from more than 2100 mobile
numbers were asked to update their KYC. Forged URL Links were
prepared which were looked like link of the State Bank of India and
after getting information from the customers, they were cheated. It
was also transpired during investigation that mobile numbers were
forwarded from the Bulk Messenger, a Foreign Company and
therefore, no any details were collected. With the help of Cyber
Cell, applicant was inquired. Six mobiles, two laptops, one hard
disk, one bootable pendrive, eight sim cards were seized from the
applicant. It was also found that applicant is also involved in the
commission of the offence by using bootable pen drive. After every
fraud, applicant used to refresh his software. It was also found that
applicant committed fraud of Rs.2,43,000/- and received the
amount which was withdrawn systematically by using YONO Cash.
Now the investigation is over and chargesheet is filed. Applicant
was arrested on 01/11/2021. There are other five wanted accused
in this matter. Maximum punishment prescribed for the offence is
seven years.

Considering the fact that investigation is over and
applicant is resident of Jharkhand, therefore, by taking cash surety
in addition to regular surety, application can be allowed. Hence, I
pass following order.
ORDER
1
Bail Application No.131 of 2022 is hereby allowed.

Applicant Sohrab Anaulmiyan Ansari in C.R.No.44 of
2021 of West Region Cyber Police Station, Mumbai for the offence
punishable U/s.419, 420, 465, 468, 471 of Indian Penal Code and
U/s.66(C), 66(D) of Information Technology Act be released on bail
on executing PR bond of Rs.50,000/- with one or more sureties of
the same amount. In addition to this, applicant to deposit cash
surety of Rs.50,000/-.

Applicant to furnish his detailed address, phone number
at the time of furnishing bail.

Bail before the Court attending remand.

Applicant to attend court’s dates regularly without fail
unless exempted.

Applicant shall not, directly or indirectly, make any
inducement, threat or promise to any person acquainted with the

facts of the accusation against himself so as to dissuade him from
disclosing such facts to the Court or to any police officer.

Applicant shall not leave India without previous
permission of the Court.

Bail Application is disposed off accordingly.
