Applicant/accused seek his release on bail under Section
439 of Cr. P.C. in connection with C.R. No. 57/2022 registered with
Matunga Police station for the offence punishable under Sections 406,
419, 420 r/w 34 of Indian Penal Code.

The prosecution allegation reveals that in the year 2017 the
informant came in contact with the applicant. The applicant impressed
the informant as Union Leader and claimed to have contact with big
officers of MHADA. The applicant assured the informant to show a flat
at Satyam Building. The informant selected the flat as shown by the
applicant and consideration amount was fixed for Rs.25,00,000/­ out of

which Rs.12,00,000/­ was paid by the informant by cheque and cash. It
is alleged that applicant has also accepted the amount of Rs.9,00,000/­
from the witness Ganesh Vedak as consideration amount of another flat.
As applicant did not transfer the possession of the flat, the informant
and witness learn that it was only a show of flat for the purpose of
extracting money from them. Eventually, aforesaid crime is registered.

Heard argument advanced by the both the parties and
perused the case record.

On going through the case record, it appears that the
applicant has accepted the amount of Rs.12,00,000/­ from the
informant as well as Rs.9,00,000/­ from witness Ganesh under the guise
of providing them flat. However, the applicant dupe the informant and
witness and caused their wrongful loss. It appears that investigation is
in midway. There may be other persons who are cheated like the
informant. If the applicant is released at this stage than there is every
possibility that he may create hurdle in the investigation. Considering
the nature of accusation, the investigation is in midway and possibility
of tampering of witnesses, dissuaded this Court to release the applicant
on bail at this stage. Hence, the following order :­
ORDER
1.

Criminal Bail Application No. 821 of 2022 is rejected.

2.

Criminal Bail Application No.821 of 2022 stands disposed of
accordingly.
