ORDER

This is an application U/s.439 of Code of Criminal
Procedure(hereinafter referred to as “Cr.P.C.) for the grant of bail
to the applicant Shamim Shaikh @ Token @ Samir S/o Abdul
Shaikh in C.R.No.445 of 2021 of Kurla Railway Police Station for
the offence punishable U/s.379 of Indian Penal Code(hereinafter
referred to as IPC).

Perused the application. Heard both the sides.

Informant is Suraj Zagaru Munda. He lodged report
that on 26/10/2021, he was sleeping in the open space of
Lokmanya Tilak Terminus. At that time, applicant committed theft
of his mobile. Mobile is recovered from the applicant. Applicant is
aged about 51 years.

As the mobile is recovered and this is
application for grant of regular bail. Considering the facts and
circumstances of the case, I am inclined to allow the application.
Hence, I pass following order.
ORDER
1
Bail Application No.158 of 2022 is hereby allowed.

Applicant Shamim Shaikh @ Token @ Samir S/o Abdul
Shaikh in C.R.No.445 of 2021 of Kurla Railway Police Station for
the offence punishable U/s.379 of Indian Penal Code be released
on bail on executing PR bond of Rs.25,000/- with one or two
sureties of the same amount.

Applicant to furnish his detailed address, phone number
at the time of furnishing bail.

Bail be furnished before the Court attending remand.

Applicant to attend Kurla Railway Police Station,
Mumbai as and when called by the investigating officer.

Applicant shall not, directly or indirectly, make any

inducement, threat or promise to any person acquainted with the
facts of the accusation against himself so as to dissuade him from
disclosing such facts to the Court or to any police officer.

Applicant shall not leave India without previous
permission of the Court.

Bail Application is disposed off accordingly.
