ORAL ORDER
Present application is placed by applicant/accused for bail in
appeal
wherein
the
sentence
is
challenged
passed
in
CC
No.6659/SS/2019 dt.3.1.2020.

Ld. Adv. for the applicants submit that during the pendency of
trial, the applicant/accused is on bail. There is possibility of getting
acquittal
through
present
appeal.

Hence,
he
prayed
that
applicant/accused be enlarged on bail during the hearing and disposal
of appeal. Ld.Adv. for the respondent resisted the application and
claimed rejection of it.

Pursuant to the order passed in Misc.

Application No.1406 of 2022, the execution of sentence is suspended.
Consequently, the applicant is entitled for bail during the pendency of
appeal subject to condition precedent. In the result, following order is
passed:
ORDER
1.

Bail Application No. 1811 of 2022 is allowed.

2.

Applicant/accused is released on bail on execution of PR Bond of
Rs.15,000/­ with solvent surety of like amount till the final disposal of
the appeal.
3.

The
order
of
bail
would
be
treated
as
cancelled,
if
applicant/accused will make default to pay the amount of Rs.2,08,000/­
pursuant to the order passed in MA. No.1406 of 2022.
4.

Bail Application is disposed of.
