ORDER
Applicant has filed present application under section 439 of
Cr. P.C. Applicant is arrested in C. R. no. 702 of 2022 registered with
Bandra Police Station for the offence punishable u/s. 354 of I.P.C on the
accusation that the applicant/ accused on 04/05/2022 at about 16.00
pm outraged the modesty of informant.

Heard Ld. advocate for applicant. He submitted that the
applicant is implicated in the false case. There is no material on record
against accused. Now the charge sheet is filed against him. Therefore
further custody of accused is not required. Accused is ready to abide by
the terms and conditions imposed by this court. Hence he prayed for
bail.

Nobody appeared for prosecution.

Perused say filed by IO. Accused is charged for the offences
punishable u/s. 354 of IPC. Admittedly the charge sheet is already filed
against him. Therefore further custody of accused is not required. The
accused is ready to abide the terms and condition imposed by the court.
The offence is not punishable with life imprisonment or death. No case
is made out by the prosecution to reject the bail application. Hence, I
proceed to pass following Order :ORDER
1. Bail Application No. 1575/2022 is allowed.
2. The accused Samim Munim Shah be enlarged on bail on
executing P.R. Bond of Rs. 15,000/-(Rs. Fifteen Thousand
only) with one or two sureties in the like amount on the
following conditions :a) He shall not threaten or pressurize the informant and
the witnesses.
b) He shall provide his residential, native address proof as
well as service place address proof and contact numbers
within two weeks to the Investigating Officer.

c) Accused be released on provisional cash surety of Rs.
15,000/- for a period of eight weeks.
d) Amount of cash bail be deposited with Sessions
Department.
3. Bail Application stands disposed of accordingly.
