ORDER
1.

This is an application under section 439 of Code of Criminal
Procedure for bail by applicant/accused Sameer Gole, in Crime No.24
of 2022, under Sections 307, 326, 504, 143, 144, 147, and 148 of the
Indian Penal Code read with Section 4, 25 of Arms Act, and section
37(1)(A), 135 of Maharashtra Police Act, 1951 registered at Police
Station Govandi, Mumbai.

Mr. Mr. Shrijeet Raorane, Advocate for accused has submitted
that accused is innocent and he has not committed any crime.

Investigation is completed and charge­sheet is filed before the learned
Metropolitan Magistrate, Mumbai. Accused was not present at the time
of incident. He is not concerned with the alleged crime. Accused is
ready to abide by the conditions, if any imposed by the Court. Hence,
he prayed to release the accused on bail.

Mr. Siroya, learned A.P.P. for the State has submitted that
offence is serious and if the accused is released on bail than he will
abscond. He prayed to reject the application.

I have perused the charge­sheet. Investigation is completed.

Accused is in jail since long. Antecedents of accused are clear and he is
ready to abide by the conditions imposed by the Court. Co­accused is
released on bail. Therefore, accused is entitled for bail. Hence, the
following order:
Order
1.

Bail Application No.1140 of 2022 is hereby allowed.

2.

Applicant/accused namely Sameer Gole, in C.R.No.24 of 2022
registered with Govandi Police Station for the offence punishable
under Sections 307, 323, 504, 143, 144, 147, 148 of IPC rlw
Sections 4, 25 of Arms Act and Section 37(1)(A), 135 of
Maharashtra Police Act, 1951, he shall be released on his
executing PR Bond of Rs.25,000/­ (Twenty Five Thousand only)
with one or more sureties of the like amount on the conditions
that :­

He shall attend the dates of hearing regularly unless
exempted by the court.

He be released on provisional cash bail of Rs.25,000/­. Duration
of provisional cash bail shall be for four weeks.

Bail before Ld. Magistrate.

Bail Application No.1140/2022 is disposed of accordingly.
