ORAL ORDER
Applicant/accused Rizwan Ismail Khan prays for releasing
him on bail.

Applicant/accused submits that, he was arrested in Special
L.A.C./C.R. No.64/2022 in Charkop police station for an offence
punishable under section 8(c) r/w section 21(b) and 29 of the NDPS
Act, 1985. Prosecution alleged that, FIR was registered against Ankur
Radheshayam Yadav and Bushan Pratap Mukundmurari Sing. It is
alleged that, some drug was seized from them and they were arrested.
In the course of interrogation they told Investigating Officer that, they
got said drug from this applicant. Therefore, applicant was arrested.
Presently he is in MCR. He prayed for releasing him on bail.

Applicant/accused submits that, a false case is fabricated
against him. He is innocent. He cannot be involved in said incident.
Both accused are already released on bail and charge-sheet is also filed
against them. Applicant is permanently residing at the address
mentioned in title clause. He will not abscond. He undertakes to abide
by all conditions. He prayed for releasing him on bail.

Prosecution opposed this application by filing its say at
Exh-02 on grounds mentioned therein. I have heard both sides.

from
Ankur
Radheshayam
Yadav
and
Bushan
Pratap
Mukundmurari Sing. Nothing was seized from this applicant/accused.
Applicant/accused is ready to abide by all conditions and furnish surety.

Therefore, a case is made out for grant of bail. Accordingly, I pass
following order.
ORDER
1. Criminal Bail Application No.1780/2022 in Special L.A.C./C.R.
No.64/2022, is allowed.
2. Applicant/accused Rizwan Ismail Khan, is released in Special
L.A.C./C.R. No.64/2022 on executing P. R. Bond of Rs.25,000/(Rs. Twenty Five Thousand only) with one or more solvent sureties
in the like amount, on following conditions.
3. Applicant/accused shall not indulge any activity which shall hamper
the course of investigation and he shall appear before Trial Court
regularly.
4. Applicant/accused shall not tamper with evidence of prosecution.
5. Applicant/accused shall appear before the Investigating Officer as and
when called by the Investigating Officer.
6. Application stands disposed off accordingly.
