O R D E R

This is an application filed u/sec.438 of the Code of Criminal Procedure, 1973 for grant of anticipatory bail in connection with C.R. No.771/2022 registered at Dadar Police Station for the commission of offence under Section 381 of Indian Penal Code.

2.Perused application, say filed by the prosecution and intervener. Heard all the advocates at length.

3. The allegation against the accused that the informant have store of hosiery and used to sale clothes from his shop situated at Upendra Nagar, Shop No.03/01, S.B. Marg, Tulshi Pipe Rd. Dadar. The applicant / accused was working in his shop from last 10 years. On the day of incident informant has kept Rs.40 lakhs in his shop. The applicant / accused taken the key of the locker, open it behind the back of informant and stolen cash of Rs.40 lakhs from the drawer of the shop therefore, informant lodged report against him.

4.During the course of hearing informant / orig. complainant appeared in the matter. He has filed application and given no objection to grant anticipatory bail to the applicant / accused. It is alleged by the informant that majority part of the amount was recovered and applicant / accused not intentionally committed the alleged act. As the matter is settled in between the parties Therefore applicant is entitled for the protection as prayed. Hence, considering this I pass the following order :

ORDER

1.Anticipatory Bail Application No.2842 of 2022 is allowed.

2.Applicant / accused Ritik S. Yadav @ Ram Kumar is ordered to be released on executing on P.B. Rs.15,000/­ with one or two sureties of like amount in the event of arrest in Crime Number 771/2022
registered at Dadar Police Station under Section 381 of The Indian Penal Code :

b. that the applicant / accused shall not, directly; or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the accusation against him so as to dissuade him from disclosing such facts to the Court or to any police officer.

c. that the applicant / accused shall not leave India without the previous permission of the Court.

4.The applicant / Accused not to tamper with the prosecution witnesses and evidence in any manner.

5.Provisional cash bail allowed for 4 weeks from today.

6.Anticipatory Bail Application. No.2842 of 2022 is disposed off accordingly.
