ORAL ORDER
This application is for bail, which is moved under Section
439 of the Cr.P. Code, in respect of C.R.No.468 of 2022 registered at
R.C.F. Police Station, Mumbai, for offences punishable under Section
326, 323, 504 and 34 of Indian Penal Code.

The applicants/accused were arrested by R.C.F. Police
Station on 03.07.2022 in the said crime and since them they have been
in custody.

The FIR in short discloses on 02.07.2022 around 10 p.m.

When the first informant was talking with one of the security guards
Deepak Jogwani, the accomplish of the applicants/accused namely Kalu
Dhanawat came there and started scuttle with the first informant.
Because of that first informant ran in to the mall namely Qubik mall at
that time the applicants/accused and their accomplice chased and
assaulted him by hand and kick blows. Then the applicants/accused
Ravi picked up AC sheet and dealt blow thereof on the head of the first
informant, because of which the first informant sustained bleeding
injury on head. Blood was also oozing out eyes and nose.

The State has strongly objected the application on the
ground that the offences are serious in nature. If applicants/accused
are released on bail they will commit the same offence and flee from
justice.

The applicants/accused seeks that the they are permanent
resident of Mumbai. They have falsely implicated in the said crime. The
investigation is already over. The first informant is also discharged from
the hospital on 05.07.2022 and it will not be proper to curtail their
liberty furthermore.

This Court has already granted bail to accomplice of the
applicants/accused Namely Kalu Dhanawat by order dated 11.07.2022.
So far as the applicant accused no.2 is concerned same rule need not to
be applied being similar role played. So far as the applicants/accused is
concerned allegation in that, he assaulted by A.C. sheet on the head of
the first informant. So he is sustained blooding injury. No doubt this
act of the applicant/accused no.1 is serious in nature But the fact is that
the first informant is discharged from the hospital on 05.07.2022, and
no medical certificate of him is put on record by the prosecution to
show gravity of the injury. In such situation and facts, he also needs to
be released on bail on ground and parity so following order is passed:ORDER
1.

Bail Application No.1693 of 2022 is allowed.

2.

Accused/applicants Ravi Chandra Loda and Ashish Tukaram Kule
are released on bail in C.R.No.468/2022 on furnishing P. R.
Bond of Rs. 25,000/-(Rs.Twenty Five Thousand Only) with one
or two surety/s in the same amount each.

3.

Provisional cash security of Rs.25,000/- is allowed.
Which will remain in force for two months. Meanwhile,
applicants/accused have to furnish surety as directed above.

They shall not tamper with the evidence and co-operate with the
investigating officer in investigation.

Bail before the Lower Court.

6.

Bail Application No.1693 of 2022 stands disposed off
accordingly.
