ORDER

This is an application U/s.439 of Code of Criminal
Procedure(hereinafter referred to as “Cr.P.C.) for the grant of bail to
the applicant Rajubhai Ramjibhai Badreshwara in C.R.No.965 of
2021 of L.T. Marg Police Station, Mumbai for the offence

punishable U/s.406, 419, 420, 467, 120B r/w. 34 of Indian Penal
Code.

Perused the application. Heard both the sides.

As per case of the prosecution, informant is Rajgopal
Somani. He alongwith his partner Subhash Chavan was intending
to invest the amount. Accordingly, they paid the amount of Rs.2
Crores to co-accused Ashwin Nanubhai Kothiya @ Patel, an
Angadiya agent. Said co-accused is working under the name and
style as Angadiya P Keshavlal and Company, Mirza Street,
Kamalram Building, 2nd Floor, Office No.10, Zaveri Bazar, Mumbai.

Allegation against the applicant is that said office No.10
is taken by the applicant on rent and therefore, he is one of the
conspirators. Investigation is over and chargesheet is filed. Coaccused Ashwin Nanubhai Kothiya @ Patel is released on bail.
Other accused are also released on bail. Applicant is arrested on
23/07/2021. All the offences are triable by the Magistrate’s Court.
Considering all these facts, I am inclined to allow the application.
Hence, I pass following order.
ORDER

Bail Application No.897 of 2022 is hereby allowed.

Rs.50,000/- with one surety of the same amount. In addition to
this, applicant to deposit cash surety of Rs.50,000/-.

Applicant to furnish his detailed address, phone number
at the time of furnishing bail.

Bail before the Court attending remand.

Applicant shall not, directly or indirectly, make any
inducement, threat or promise to any person acquainted with the
facts of the accusation against himself so as to dissuade him from
disclosing such facts to the Court or to any police officer.

Applicant shall not leave India without previous
permission of the Court.

Bail Application is disposed off accordingly.
