ORAL ORDER
I have perused the application and say. I have Heard both
sides.

It appears applicant/accused Rajendra Shivram Pawar was
arrested by police on 17.07.2022. It is alleged that, he was found in
possession of 300 grams Ganja. It was seized and an offence number
42/2022 was registered in police station RAK Marg. Presently he is in
MCR. His bail application was rejected by Metropolitan Magistrate 7 th
Court, Dadar, Mumbai vide order dated 20.07.2022. Therefore, he filed
bail application under section 439 of Cr.P.C. He prayed for releasing
him on bail.

Prosecution resisted this application by filing its say on
grounds mentioned therein.

In this case small quantity of Ganja (300 grams) was
allegedly seized from applicant/accused. Offence punishable under
section 20(b) of the NDPS Act would attract rigorous imprisonment for
a term which may extend to one year and fine which may extend to
10,000/- rupees. Applicant is ready to furnish surety and abide by all
conditions those may be imposed by this Court. Section 37 will not be
attracted in this case. Hence, a case is made out for grant of bail.
Accordingly, I pass following order.

ORDER
1. Criminal Bail Application No.1823/2022 in Special L.A.C./C.R.
No.42/2022, is allowed.
2. Applicant/accused Rajendra Shivram Pawar, is released in Special
L.A.C./C.R. No.42/2022 on executing P. R. Bond of Rs.25,000/(Rs. Twenty Five Thousand only) with one or more solvent sureties
in the like amount, on following conditions.
3. Applicant/accused shall not indulge any activity which shall hamper
the course of investigation and he shall appear before Trial Court
regularly.
4. Applicant/accused shall not tamper with evidence of prosecution.
5. Applicant/accused shall appear before the Investigating Officer as and
when called by the Investigating Officer.
6. Application stands disposed off accordingly.
