ORDER
The appellant/orig. accused has filed application for
seeking bail. The applicant is convicted by order dated 7.6.2022 passed
by the Learned Metropolitan Magistrate, 56th Court, Mazgaon, Mumbai,
BA 1607/2022 in Cri.Appeal No.391/2022

in C.C.No.5607133/SS/2019, for the offence punishable under Section
138 of Negotiable Instrument Act, 1881. He has filed appeal against
said judgment.

Heard Ld. Advocate for the appellant/orig. accused and
Ld. Advocate for the respondent No.1.

Perused impugned order. The offence is punishable under
section 138 of Negotiable Instruments Act, 1881. The appeal will take
its own time to ripe for final hearing. Nothing will gain by keeping the
appellant/orig. accused behind the bar. He was on bail during trial.
Looking to the aforesaid circumstances, appellant/orig. accused is
entitled to grant bail Thus, I proceed to pass the following order:­
ORDER
Bail Application No. 1607/2022 is allowed.
Appellant/Orig. Accused be released on his executing P.R.Bond of
Rs.15,000/­(Rupees Fifteen Thousand Only) with surety in the like
amount.
