The applicant seek his release on bail under Section 439 of
Cr. P.C. in connection with C.R. No.90/2022 registered with Kalachowki
Police Station for the offences punishable under Sections 353, 504, 506,
34 of the Indian Penal Code.

Briefly stated, on 23.03.2022 customer namely Bhakti came
in SBI Bank, Lalbaug branch and complained about the wrongful
deduction of Rs.10,000/­ from her account. The bank personal

appraised her to check online transaction and asked her to come on
next day. On 24.03.2022 again customer Bhakti came in bank and
inquired about the amount deducted from her account. She was not
satisfied with the reply given by the banker. She raised quarrel with
them. Later on, her brother (applicant) came in Bank and deter the
bank employees in discharge of their duty. Eventually, the informant,
bank employee lodged the report.

Heard both sides and perused the case record.

On going through the case record, it appears that the said
incident is occurred on 24.03.2022. The applicant was arrested on
24.03.2022 and since then he is in judicial custody. It appears that the
investigation is considerably progressed. There is no recovery at the
instant of applicant. Considering the nature of allegation and witnesses
being the bank employees, further incarceration of applicant is
unwarranted. Eventually, the applicant is released on bail. Hence, the
following order :­
ORDER
1.

Criminal Bail Application No.683 of 2022 is allowed.

2.

Applicant/accused Prasad Maruti Adhikari be released on bail on
his furnishing P.R. Bond of Rs.15,000/­ along with surety of like
amount in connection with C.R. No.90/2022 registered with
Kalachowki Police Station for the offences punishable under
Sections 353, 504, 506, 34 of the Indian Penal Code.

Applicant/accused shall furnish his residential address proof and
contact numbers to Investigating Officer.

5.

The applicant/accused shall not directly or indirectly, make any
inducement, threat or promise to any person acquainted with the

facts of the case so as to dissuade him from disclosing such facts
to the Court or to any Police Officer.
6.

Applicant/accused shall not leave India without the previous
permission of the Court.

7.

Bail before Lower Court.

8.

Criminal Bail Application No.683 of 2022 stands disposed of
accordingly.
