Present application is filed by the applicant for grant of bail
in Crime No.108/2022 registered with Worli Police Station, for the
offences punishable under Section 465, 467, 468, 469, 471, 341, 457,
454, 380, 504, 506 of IPC.

It is the case of prosecution that the informant Dr. Ajay
Trambakrao Salunkhe lodged report dated 12.03.2022. It is contended
that informant owned gala no.1 situated at BDD chawl no.94, B. N.
Vakrikar Marg, Worli, Mumbai and he was using it as a store room for
keeping medical equipments and medicines. On 08.03.2022 at about
10.00 am the informant went at said gala and found that there was no
lock on its door. It is alleged that on inquiry by the informant, the co­
accused Samarth Gaikwad approached to him and informed him that he
is residing in the said gala and it is purchased by his father about 27
years back. He also stated to informant that he would make call to him
and would show him the title documents. It is alleged that on
10.03.2022 at 4 pm, when informant went inside the gala the medical
equipments and medicines were missing and co­accused started abusing
the informant. It is alleged that the co­accsused with the aid of present
applicant, made fabricated documents and obtained electricity meter in
the said gala. Accordingly, crime is registered against the applicant and
co­accused.

The Learned advocate for applicant submitted that
applicant is falsely implicated in crime. The applicant is arrested on
15.03.2022. He was remanded to PCR till 17.03.2022. Since then, he is
behind bar. He is ready to abide conditions imposed and prayed for
grant of bail.

Per contra, vide Say (Exh.2), Ld. APP opposed the
application.

It is submitted that the offence is serious in nature.

Investigation is in progress. There is possibility of tampering the
prosecution witnesses. Hence, prayed for rejection of the application.

Perusal of FIR, it is alleged that the co­accused illegally
breaking the lock of gala of the informant and taken away the
equipments etc. It alleged that co­accused on the basis of fabricated
documents obtained electricity meter at the premises. The allegations
against the applicant are that he had aided the accused of making
fabricated documents. The accused is said to be arrested on 15.03.2022.
He underwent police custody remand and thereafter he is in Magistrate
custody. The alleged fabricated documents are already seized by the
police from the co­accused. The offences are triable by Magistrate. It
would not be appropriate to keep the accused behind bars indefinitely.
The applicant is ready to abide the condition imposed. Considering the
matter, there would not be prejudice to the prosecution if suitable
conditions are imposed while granting bail to the applicant.

Hence, I
proceed to pass following order :­
ORDER
1.

Bail Application No.789 of 2022 is allowed.

Police Station, on furnishing P. R. bond of Rs.15,000/­
(Rupees Fifteen Thousand Only) with surety of like amount.

He shall not commit any other or similar offence.

5.

He shall furnish the document of his permanent and
temporary residential address, to the Investigating Officer.

He shall give intimation in writing to I.O. and Ld. M.M. Court
as and whenever he change his residential/temporary
address.

7.

He shall not directly or indirectly make any inducement,
threat or promise to informant or any person acquainted with
the facts of the case so as to dissuade him/her from disclosing
such facts to the Court or tamper with the evidence.

8.

Breach of any of the conditions of this order shall be a ground
for its cancellation.

9.

Provisional cash bail allowed for six weeks from today.

10. Bail to be furnished before Learned Metropolitan Magistrate
Court.
