This is an application for bail under Section 439 of Cr. P.C.
Heard Ld. Advocate for the applicants and Ld. APP for the State.
Perused documents on record.

The Ld. Advocate for applicant submitted that applicant is
arrested by Mankhurd police station in connection with Crime No.74/24

for the offence punishable under Sections 353, 332, 189, 504, 506 of
IPC. It is further contention of applicant that he is falsely implicated by
police in this case. Nothing is to be seized at the instance of applicant.
Hence, there is no need of further custodial interrogation of applicant.
Applicant is permanent resident of Mumbai. Applicant is only earning
member of his family. Therefore, he prayed for grant of bail.

Ld. APP and IO opposed the application. It is further
contention that there is 12 crime is registered on applicant. Applicant is
released on bail there is possibility of tempering of evidence of
prosecution. Therefore, he prayed for rejection of application.

In view of submissions from both sides and on perusal of
the first information report, it reveals that On 05.03.2024 at about
11.00 am informant was doing patrolling with his colleague near
Babu bhai Chawl, Transits camp, Mankhurd-Ghatkoper link road,
Mankhurd. At that time accused found in suspicious condition on the
spot. When the informant inquired with applicant, the applicant started
abusing him and other staff. Therefore, informant and other police staff
taken applicant in to custody and brought to police station. In view of
allegation in FIR nothing is to be seized at the instance of applicant.
The Ld. Advocate for applicant submitted that, though 12 cases are
shown as pending most of the cases are disposed off. Therefore, in such
circumstance further detention of applicant is not required. Hence, by
imposing condition applicant may be released on bail. Therefore, I pass
following order :-

ORDER
1.
Criminal Bail Application No.675 of 2024 is allowed.
2.
Applicant/accused Mohasin Mehboob Shaikh be released on bail
on furnishing P.R. Bond of Rs.25,000/- along with one or more
sureties in the like amount in connection with C.R. No.74/24
registered with Mankhurd police station.
3.
Applicant/accused
shall
attend
Mankhurd
Police
Station,
Mumbai, as and when required by Investigating Officer on notice.
4.
Applicant/accused shall furnish his residential address proof and
contact numbers to Investigating Officer.
5.
Applicant/accused shall not directly or indirectly, make any
inducement, threat or promise to any person acquainted with the
facts of the case so as to dissuade him from disclosing such facts
to the Court or to any Police Officer.
6.
Applicant/accused shall not leave India without previous
permission of the Court.
7.
Bail before learned Court below.
8.
Criminal Bail Application No.675 of 2024 stands disposed of
accordingly.
