This is an application under section 439 of Cr.P.C. for bail by
B.A.218/2022

Order
applicants/accused in crime No.9/2022 under section 307,386,387,
143,144,148,149, of IPC and section 3,4,25 & 27 of Arms Act r/w
section 37(1) (a),135 of Maharashtra Police Act, registered at police
station Deonar, Mumbai.

Mr.R.G. Gadgil Advocate for applicants/accused has submitted
that applicants are innocent and they have not committed any crime. No
specific role is assigned to the applicants. The injured was treated as an
OPD patient. Applicants are permanent residents of Mumbai and
undertakes to abide by the conditions, if any, imposed by the Court.
Hence, he prayed to release the applicants/accused on bail.

Mr. Ramesh Siroya, APP for the State has submitted that offence
is serious. Investigation is in progress. And if the accused are released
on bail then they will pressurize the witnesses. He prayed to reject the
application.

I have Perused the FIR and say of prosecution. It is alleged that
present accused and coaccused forcibly recovered “Hafta” from the
shop owners in the area. Complainant’s father runs shop in the said
area and accused had recovered Hafta from him. It is also alleged that
due to harassment by accused complainant’s brother closed his newly
opened washing center. The incident occurred on 4/1/2022 and
5/1/2022. It reveals that accused were armed with revolver, sword
etc… Accused Saddam made two rounds of firing. Accused were also
threatening to other peoples.
Accused also caused injury to the
complainant and his father. Thus, offence is serious investigation is in
progress. Hence, at this juncture, if the accused are released on bail

then they will pressurize the complainant and witnesses.
Hence,
applicants/ accused are not entitled for bail. Therefore, following order.
ORDER
BA No.218/2022 is rejected and stands disposed of
accordingly.
