Applicant/accused seek his release on bail under Section
439 of Cr. P.C. in connection with C.R. No. 216/2022 registered with
Wadala T.T. Police station for the offence punishable under Section 392
of Indian Penal Code.

Prosecution allegation reveals that on 21.04.2022 at
around 10.15 a.m. informant was proceeding to his work place at
Champaklal Estate, Sion (E). When his car stop at the signal of Bagla
Garden, Shanti Nagar, Wadala (E), at that time, applicant entered the
car and snatched mobile handset and cash amount from the pocket of

the informant on the point of knife and flee away. Eventually, aforesaid
crime is registered.

Heard both the sides and perused the application, its
annexure and police report Exh.2.

On going through the investigation papers, it appears that
the applicant is nabbed on the same day. During the police custody, the
stolen mobile handset, cash amount and knife is recovered from the
applicant. After going through initial police custody on 27.04.2022 he is
brought back to judicial custody and since then the applicant is behind
bar. The booty of the crime is returned to the informant. It appears that
investigation is considerably progressed and further incarceration of
applicant is unwarranted. It appears that applicant is 20 years old and
his further incarceration would lead in the contact of harden criminals.
Considering the nature of accusation and progressed investigation, the
applicant is released on bail on stringent conditions. Hence, the
following order :­
ORDER
1.

Criminal Bail Application No. 1064 of 2022 is allowed.

2.

Applicant/accused Mohammed Ayubali Raju Khan be released on
bail on his furnishing P.R. Bond of Rs.15,000/­ along with surety
of like amount in connection with C.R. No. 216/2022 registered
with Wadala T.T. Police station for the offence punishable under
Section 392 of Indian Penal Code.

Applicant/accused shall furnish his residential address proof and
contact numbers to Investigating Officer.

Applicant/accused shall mark his attendance at Wadala T.T.

police station on each Monday between 11.00 a.m. to 2.00 p.m.
till filing of charge­sheet.
5.

The applicant/accused shall not directly or indirectly, make any
inducement, threat or promise to any person acquainted with the
facts of the case so as to dissuade him from disclosing such facts
to the Court or to any Police Officer.

6.

Applicant/accused shall not leave India without the previous
permission of the Court.

7.

Bail before Lower Court.

8.

Criminal Bail Application No.1064 of 2022 stands disposed of
accordingly.
