ORDER
Present application is placed by applicant/accused for bail in
appeal wherein the sentence is challenged passed in CC No.
16/SS/2021 dt.20.5.2022.

Ld. Adv. for the applicant submits that during the pendency of
trial, the applicant/accused is on bail. There is possibility of getting
acquittal through present appeal. Furthermore, compromise took place
in between the applicant and the complainant. Consent terms are
placed on record. Hence, he prayed that applicant/accused be enlarged
on bail during the hearing and disposal of appeal. Respondent in person
resisted the application claiming that objection if consent terms are not
fulfilled. Consent terms indicate that the amount is finalized for sum of

Rs.2 Lakhs towards final settlement and complainant admitted that
today she has received Rs.25,000/­ towards part payment of settlement.
Consequently, pursuant to the order passed in Misc. Application
No.1401 of 2022, the execution of sentence is suspended. Therefore,
the applicant/accused
is
entitled for bail during the pendency of
appeal subject to condition precedent. In the result, following order is
passed:
ORDER
1.

Bail Application No. 1805 of 2022 is allowed.

2.

Applicant/accused is released on bail on execution of PR Bond of
Rs.15,000/­ with solvent surety of like amount till the final disposal of
the appeal.
3.

Bail Application is disposed of.
