ORDER

The applicant Smt. Meena Dattarya Jadhav has filed this
application under Section 439 of the Code of Criminal Procedure for
granting bail in connection with Crime No.707/2023 registered with
Mulund Police Station, Mumbai for the offences punishable under
Sections 420, 408, 465, 467,468, 471 r/w. 34 of the Indian Penal Code,
on the allegations that the applicant and co-accused forged bills on the
say of suppliers and contractors, recovered additional amount from
them and misappropriated the said amount.

The investigating officer through learned A.P.P. filed reply
(Exh.04) and strongly opposed the application. It is contended that the
applicant and co-accused were employees of Bangera Seaworld Pvt. Ltd.
Company, belonging to the informant. The applicant and co-accused in
furtherance of their common intention and in collusion with suppliers
and contractors forged bills, recovered huge amount from them and
misappropriated
Rs.8,85,09,835/-.

The
offence
is
serious
and
investigation is in progress. In such circumstances, if the applicant
released on bail there is possibility of pressurizing the prosecution
witnesses and fleeing away from justice. Hence, the investigating officer
prayed to reject the application.

The informant Shri Kishore M. Bangera, appeared through
advocate as an intervener and opposed the application. The intervener
also raised similar grounds which are raised by the investigating officer
in his reply and prayed to reject the application.

I have carefully gone through record with reference to
submission of both the sides. The name and role of the applicant is
specifically mentioned in the First Information Report. It is alleged that
the applicant and co-accused in collusion with suppliers and contractors
forged certain bills and earned money from them. It is further alleged
that the suppliers and contractors have transferred huge amount to the
account of the applicant and co-accused. The investigating officer
opposed the application mainly on the ground that offence is serious
and investigation is in progress. It is further contended that the
applicant is not co-operated in the course of investigation. It appears
that the investigating officer arrested the applicant on 08/02/2024 and
produced before the Metropolitan Magistrate. The applicant was
remanded to police custody till 12/02/2024 and thereafter taken into
judicial custody. In the course of investigation, it is transpired that an
amount of Rs.1,09,998/- and Rs.89,840/- transferred by the suppliers
and contractors to the account of present applicant. The above amount
was transferred to the account of applicant by Noorkutub Alam and
Krisha Seafoods. The main allegations are against co-accused. The
presence of the applicant is not necessary for any recovery or discovery.
The learned advocate for applicant submits that the applicant was
employee of the informant and her bank account is already freezed. The
offences levelled against the applicant are not exclusively punishable
with capital punishment. Nothing is placed on record about past
criminal antecedents of the applicant. There are no extra ordinary
circumstances to keep the applicant behind bar and complete remaining
part of investigation. The apprehension placed on record by the

investigating officer can be taken care of by imposing certain
conditions. In the facts and circumstances of the case, the applicant is
entitled to release on bail. Hence, the following order is passed.
ORDER
1.

Criminal Bail Application No.679 of 2024 is allowed.

2.

The applicant Smt. Meena Dattarya Jadhav be released on bail in
Crime no.707/2023 registered in Mulund Police Station for the
offences under Section 420, 408, 465, 467, 468, 471 r/w. 34 of
the Indian Penal Code on her executing P.R.Bond of Rs.50,000/(Rupees Fifty Thousand) with one or two sureties of the like
amount.

The applicant and her surety shall provide their respective mobile
numbers, e-mail address and documents pertaining to place of
residence.

4.

The applicant shall not directly or indirectly make any
inducement, threat or pressurize any person acquainted with the
facts of the present case so as to dissuade him from disclosing
such facts to the Court.

The applicant shall not leave India without prior permission of
the Court.

6.

The applicant is directed to attend the Mulund police station once
in a week i.e. on every Monday between 11.00 a.m. to 1.00 p.m.
till filing of charge-sheet and co-operate the investigating agency.

7.

Provisional cash bail in the like amount is allowed. The applicant
shall furnish surety within four weeks from the date of release
from jail, failing which the cash bail shall stand forfeited without
any separate order.

8.

Breach of any conditions by the applicant shall result in
cancellation of bail.
