ORAL ORDER

The applicant/accused was arrested on 01.05.2021. He was then
released on bail on 10.05.2021. For eight months applicant/accused was
regularly attending police station as per direction given by MM Court
while granting him bail on 10.05.2021. The prosecution then decided to
apply offences under MCOC Act against all the accused. So applicant/
accused was re-arrested. Thereafter the Deputy Commissioner of Police
denied to sanction the prosecution under MCOC Act against all the
accused. Additional Session Court bearing No.55 by an order dated
30.05.2022 directed police station to file regular charge-sheet against

all accused before the Metropolitan Magistrate Court for the offences
inrespect of which the applicant/accused was released on bail. Once the
Sessions Court has held that all offences leveled against the
applicant/accused falling under I.P.C are triable by the Magistrate Court
the accused is entitled for the bail as directed by Ld. Magistrate by his
earlier order dtd. 10.05.2021. Accordingly following order is passedORDER
1.

Accused Mohd. Saif Iftikar Shaikh in C.R.No.197/2021 be released
on bail on furnishing PB and SB of Rs.15000/- (Rupees Fifteen
Thousand only).
2. He can furnish the provisional cash security of Rs. 15,000/- (Rupees
Fifteen Thousand only) and furnish regular surety within 8 weeks.
3. Bail before Lower Court.
