is

application
for
regular
bail.

The
respondent/State resisted it by filing say at Exh.2. Read the application
and say. Heard both sides. Perused the record.

It is alleged that the applicant found in possession of
contraband articles (Rajashri Pan Masala) worth of Rs.18,000/- and
thereby, committed an offence punishable under Sections 328, 188,
272, 273 of the Indian Penal Code and Sections 26(2)(i), 26(2)(iv),
27(3)(d), 23(3)(e), 3(i)(zz)(v), 30(2)(a), 59 of Food Safety and
Standards Act, 2006. The offence is registered as Crime No.457 of 2022
with Dharavi police station. Learned A.P.P. strongly resisted the
application by submitting that if the applicant is released on bail, he
would deal in contraband articles, tamper the evidence and would not
available for the trial. However, no material is placed on record in
support of the submissions. The applicant has no criminal antecedent.
He is permanent resident of Mumbai. Considering these facts, it would
be just and proper to grant conditional bail to the applicant.
Accordingly, I pass the following order :ORDER
1.

Bail Application No.1048 of 2022 is hereby allowed.

Applicant Javed Ahmed Bashir Ahmed Khan in C.R.No.457
of 2022 registered with Dharavi police station for the offence
punishable under Sections 328, 188, 272, 273 of the Indian Penal Code
and Sections 26(2)(i), 26(2)(iv), 27(3)(d), 23(3)(e), 3(i)(zz)(v),
30(2)(a), 59 of Food Safety and Standards Act, 2006, shall be released
on bail on executing P.R. bond of Rs.20,000/- with one or more sureties
in the sum aggregating to Rs.20,000/-, and on following conditions :(a)
He shall not tamper with the witnesses and evidence ;
(b)
He shall furnish his detail address, mobile/contact number,
address proof and identity proof at the time of furnishing bail ;
(c)
In case of change of his residence or mobile/contact
number, he shall inform it to the Court and Investigating Officer ;

He shall attend the Court regularly ;
(e)
He shall co-operate with the Investigating Officer.

3.
Bail shall be furnished before concerned Metropolitan
Magistrate.
